Hirst Applegate attorneys Billie Addleman and Macrina Jerabek successfully represented a northern Wyoming coal mine in contesting a workers’ compensation claim. The former employee alleged he contracted an infectious disease due to a workplace injury resulting in multiple amputations and loss of limb. During discovery, Addleman and Jerabek obtained additional evidence and admissions causing the infectious disease expert to change his opinion on causation. Following the contested case hearing, the hearing examiner issued an order denying benefits and finding the claimant failed to prove he suffered a compensable workplace injury.  The finding will potentially save the client $150,000.00 in workers’ compensation premiums over the next three years.
